Disney to Face Gina Carano in Court Next September

Disney will face Gina Carano in court despite the company’s attempt to delay her sex discrimination and wrongful dismissal lawsuit with a stay of proceedings and interlocutory appeal which was denied by a California court. The trial will proceed Sept. 29, 2025.  

U.S. District Judge Sherilyn Peace Garnett wrote in her decision that Disney could not show that a trial postponement “would alleviate the burden of responding to the discovery Plaintiff has propounded to date, nor is it apparent to the Court how such a decision could provide such relief.”  

Carano, who starred as bounty hunter Cara Dune in THE MANDALORIAN, was fired in 2021 for her controversial statement about the current political climate. 

In the post, she wrote, “Jews were beaten in the streets, not by Nazi soldiers but by their neighbours…even by children…Because history is edited, most people today don’t realise that to get to the point where Nazi soldiers could easily round up thousands of Jews, the government first made their own neighbours hate them simply for being Jews. How is that any different from hating someone for their political views?”  

The MMA fighter was already under fire for her previous right-leaning comments about the COVID vaccine and gender pronoun usage, but the post was the “final straw,” Disney wrote in a dismissal motion, adding that her post trivialized the Holocaust, “by comparing criticism of political conservatives to the annihilation of millions of Jewish people.” 

“Defendants have not identified any evidence — in the Complaint or otherwise — to substantiate a claim that they employ public-facing actors for the purpose of promoting the ‘values of respect,’ ‘decency,’ ‘integrity,’ or ‘inclusion,’” Judge Garnett responded in a denial of the House of Mouse’s motion to dismiss the case earlier this year. 

The lawsuit states that Carano was singled out for her beliefs while pointing out that costar Pedro Pascal made politically charged statements on social media comparing Donal Trump to Hitler as well as posts supporting LGBTQ+ rights, Black Lives Matter and defunding the police, with no reprimand from Disney. 

Carano respects the rights of her co-stars to express their views on social media, even if they differ from her own, and she remains personally fond of each of them,” the lawsuit states. “However, Defendants’ treatment of Carano stands in stark contrast to Defendants’ embrace of her male co- stars and other male employees.” 

Carano recently shared on X her response to the judge’s decision. 

“I am obviously very pleased with the opportunity to keep moving forward with the judicial process and into discovery,” the 42-year-old posted. “While I wish this was not necessary as it is not my desire to be in this battle in court, I will not shrink away from it because it is hard or uncomfortable.” 

X owner Elon Musk took over Carano’s legal fees earlier this year after stating that he would back any lawsuit of someone who was wrongfully fired for a post on his platform. 

“If you were unfairly treated by your employer due to posting or liking something on this platform, we will fund your legal bill. No limit,” Musk wrote.

“You might not want to have anything to do with politics but politics whether you like it or not, will have everything to do with you and the generations who follow you,” she wrote. “This election, do not let someone else use your voice and your vote, they will ultimately use it against you. Remind the government who they work for…We the people.”
