Texas Abortion Heartbeat Law Stands After Appeal Court Decision: ‘Babies Will Be Saved’

On Apr. 26, a federal appeals court upheld Texas’ new heartbeat abortion ban, despite abortion clinics’ efforts to overturn the bill.
The heartbeat bill, which took effect on Sept. 1, 2021, prevents abortions if a heartbeat is detected. The bill also allows citizens to sue abortion doctors who violate the new law.
“This court remands the case with instructions to dismiss all challenges to the private enforcement provisions of the statute,” the U.S. Fifth Circuit Court of Appeals wrote in their decision.
The case in question involved a lawsuit by pro-choice organizations against the Texas Medical Board, Texas Board of Nursing, Texas Board of Pharmacy and Texas Health and Human Services Commission.
Texas Gov. Greg Abbott responded on Twitter: “Fifth Circuit Court of Appeals effectively ends all challenges to Texas Heartbeat Act. All babies with a heartbeat will be saved from the ravages of abortion in Texas.”

In January, the Texas Supreme Court determined that the same four entities had the authority to enforce the heartbeat law.

Despite the mainstream narrative that encourages abortion, a recent victory came after Texas passed a strict pro-life bill that outlawed abortions after a detectable heartbeat.
According to the Texas Policy Evaluation Project, the state’s bill had the desired effect, as there was a 38% decrease of abortions in 2020 after Gov. Greg Abbott’s new law.
“We are the first state to be able to enforce a heartbeat bill, and lives are being saved every day because of this work,” John Seago, legislative director for Texas Right to Life, told The New York Times, adding that it is “a phenomenal success for the pro-life movement.”
